Many companies are still yet to comply with the Energy Savings Opportunity Scheme (ESOS), so how can they get ESOS help? We’re calling on the Environment Agency (EA) to support our ESOS amnesty.

You may have missed the ESOS Phase 1 compliance deadline, never got round to submitting your ‘Intent to Comply’ by 29 January 2016, and didn’t manage to hit the ‘unofficial’ compliance deadline by 30 April 2016. Now you have an enforcement notice on your doorstep – and you’re not the only one.

Even after all the ESOS Phase 1 deadline extensions, the EA confirmed earlier this year that there were still 500 organisations that should have complied but had so far failed to engage. At that time, the EA had already served 300 enforcement notices to bring those organisations into compliance. More are on the way.

In a worst-case scenario, fines can be:

  • Failure to undertake an energy audit: £50,000 plus £500 per day for a maximum of 80 days, plus;
  • Failure to comply with a compliance notice, an enforcement notice or a penalty notice: £50,000 plus £500 per day for a maximum of 80 days.

You’re at a greater risk of fines if you ignore an enforcement notice. The good news is it’s not too late to take action – start working towards compliance now.
